Common Questions
What clients ask us first
How long does it take to register a trademark?
It varies with the USPTO's backlog and whether an office action is issued, but most applications take many months, and often more than a year, from filing to registration.
I received an office action. Is my application rejected?
Not necessarily. Many office actions can be overcome with an argument, an amendment or better evidence. What matters is responding properly before the deadline.
What happens if I miss a USPTO deadline?
An application can be abandoned and a registration can be cancelled. Some missed deadlines can be cured with a petition, but options narrow quickly, so act as soon as you notice.
I am buying a brand. What do I need for the trademarks?
A written assignment that transfers the marks together with their goodwill, recorded with the USPTO. We review the registrations and prepare and record the assignment.
Someone filed a mark similar to mine. Can I stop it?
Often, yes. After an application is published, you can oppose it before the TTAB; a registered mark can sometimes be cancelled.
