When Amazon Pulls a Listing for IP Infringement

Amazon acts on intellectual property complaints quickly and investigates later. A rights owner files a report, the listing comes down, and the seller receives a notice that also counts against account health. Repeated complaints can put the whole account at risk, so even one deserves attention.

Read the notice before reacting

The notice identifies the type of right (trademark, copyright, utility patent or design patent), often a registration or patent number, the complaining party and a contact email. Those details decide which response fits. A trademark complaint against a listing that uses the brand name to describe compatibility is a very different problem from a design patent complaint about the product's shape.

Retraction is often the fastest fix

When a complaint was filed in error, the quickest route is for the rights owner to retract it, which Amazon processes directly. A short, factual message explaining why the listing does not infringe, sent to the contact in the notice, works more often than sellers expect, especially when the complainant targeted the wrong product or a broad set of ASINs.

When the goods are genuine

Reselling authentic branded products is generally lawful. Supplier invoices from an authorized source support an appeal. The listing itself must not suggest an affiliation with the brand that does not exist, and that is where many resellers get caught.

When an attorney letter helps

For complaints that are wrong on the merits, the strongest appeal is usually a non-infringement letter from a U.S. attorney. It identifies the asserted right, compares it with the product and explains why there is no infringement. For trademarks that may mean showing the brand name was used descriptively to identify compatibility. For design patents it means comparing the overall appearance of the claimed design and the product the way an ordinary observer would, including the prior art. Platform teams give these letters weight because they are specific and signed by someone accountable for them.

Utility patent complaints are a separate track. They turn on the patent's claims, and Amazon offers a neutral evaluation process (APEX) for some of these disputes, which can be faster than court.

Fewer complaints next time

Most complaints we see could have been avoided: another company's brand name in the title or keywords, product images borrowed from elsewhere, or a design that tracks a competitor's patented product too closely. Keep sourcing and design records organized, and be deliberate about using any brand name that is not yours.

If a listing has been removed, send us the notice and the listing details. We can usually tell you quickly whether retraction, an invoice appeal or an attorney letter is the right first step.
